Alchema warranty (valid before Jan 2018)
These Warranty Terms and Conditions only apply to ALCHEMA-branded products purchased either directly from ALCHEMA, Inc. (“ALCHEMA”) or via an ALCHEMA-authorized retailer or reseller. For the purposes of these Warranty Terms and Conditions, an ALCHEMA-branded product is a product that can be identified by any “ALCHEMA” trademark, trade name, or logo affixed to such a product or such a product’s packaging (hereinafter referred to as the “Product”).
Do not use the Product until you have read these Warranty Terms and Conditions – by using the Product, you agree to be bound by these Warranty Terms and Conditions. If you do not agree to these Warranty Terms and Conditions, do not use the Product – return it within the return period stated in ALCHEMA’s Return and Refund Policy.
ALCHEMA hereby warrants that any Product that contains original manufactured parts will be FREE OF MANUFACTURING AND WORKMANSHIP DEFECTS FOR ONE (1) YEAR (“Limited Warranty”) when used normally in accordance with ALCHEMA’s instructions and published guidelines (including but not limited to technical specifications, user manuals and service communications). This Limited Warranty is only valid in the United States and Canada.
The Limited Warranty period runs from the original date of purchase, PROVIDED that any person who wishes to file a claim under the Limited Warranty for this Product produces either a warranty card, an invoice or receipt for that Product. If such information cannot be provided, or if ALCHEMA cannot otherwise verify the original purchase date, the Limited Warranty runs from two (2) months after the production date listed on the Product label. For example, if the relevant production date is August 2016, and original purchase information cannot be provided or verified, then the Limited Warranty period runs from October 2016 and expires on October 2017.
To file a claim under this Limited Warranty, contact ALCHEMA Customer Service at email@example.com. Provide the Product or item number, the original date of purchase, a description of the problem, and any additional information that will assist ALCHEMA in expediting your claim, such as an email confirming the purchase or a copy of the relevant invoice or receipt.
After receiving and processing your claim, ALCHEMA will, solely at ALCHEMA’s own discretion, elect to EITHER (A) repair the claimed problem or defect free of charge, using new or refurbished replacement parts, (B) replace the original Product with a new product that is functionally equivalent, OR (C) exchange the Product for a refund of your purchase price. Any replacement product that you receive will assume the remaining time period, if any, on the Limited Warranty attached to the original Product. When a Product is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes ALCHEMA’s property.
If ALCHEMA elects, solely at ALCHEMA’s own discretion, to repair the claimed problem or defect, return the Product to a place designated by ALCHEMA for repair. Include, or communicate to ALCHEMA, proof of purchase information, Product number, and the problem(s) with the Product. Return all hardware accessories that were originally included with the Product. You shall bear any shipping or handling charges required to return the Product and any related hardware accessories to a place designated by ALCHEMA for repair. You shall assume all risk of loss or damage to the Product and any related hardware accessories while such goods are in transit to a place designated by ALCHEMA for repair.
All repairs or replacements must be authorized by ALCHEMA in advance. Service times for repair and availability of any replacement part(s) may vary. If any necessary replacement part(s) have been discontinued or unavailable, ALCHEMA will, solely at ALCHEMA’s own discretion, elect to EITHER (A) repair any defective part(s), (B) offer a new product with the same or similar specifications, with any upgrade cost to be paid by you, OR (C) exchange the Product for a refund of your purchase price. ALCHEMA reserves the right to change the method by which ALCHEMA may provide warranty service to you.
All claims under this Limited Warranty are subject to the terms and conditions contained in these Warranty Terms and Conditions. ALCHEMA cannot guarantee that any claim submitted after the Limited Warranty has expired will be honored. If the duration of the Limited Warranty has already expired, ALCHEMA may, solely at ALCHEMA’s own option, decide to charge for any repair or replacement ALCHEMA undertakes.
The above Limited Warranty only covers Products sold directly by ALCHEMA or via an ALCHEMA-authorized retailer or reseller, and only insofar as such Products are used in ordinary household use. However, the Limited Warranty does not cover any ALCHEMA-branded product sold “as is,” including, without limitation, demonstration models or refurbished items.
THE LIMITED WARRANTY DOES NOT COVER ANY SOFTWARE PRODUCT, even if such software product is included or installed with Products or is sold by ALCHEMA or an ALCHEMA-authorized retailer or reseller. THE LIMITED WARRANTY ALSO DOES NOT COVER ANY CONSUMABLE PARTS AND/OR PRODUCT, including, but not limited to, yeast, perishables, batteries, protecting coatings, etc., even if such consumable product is included with the Products or is sold by ALCHEMA or an ALCHEMA-authorized retailer or reseller.
The Limited Warranty does not cover any cosmetic changes that do not affect performance, including, but not limited to, cosmetic damages (i.e. scratches, dents, damage to electronic plugs or ports, defacement or mutilation), discoloration or any effects of using cleaners or abrasives. The Limited Warranty also does not provide a guarantee against mechanical or software errors or interruptions that may occur during the course of normal operations in ordinary household use. The Limited Warranty does not cover normal wear and tear resulting from ordinary household usage in accordance with any instructions and published guidelines provided by ALCHEMA in any form, either written or electronic. The Limited Warranty does not cover damages caused by accidents, crashes, abuses, misuses, fires, natural disasters, earthquakes, floods, tornados, hurricanes or any other external factors. The Limited Warranty does not cover damages resulting from failure to follow instructions and published guidelines provided by ALCHEMA in any form, either written or electronic.
Companies that supply or manufacture parts or products for ALCHEMA may provide their own warranties. Inquire with the relevant company to obtain further information.
- The occurrence of any of the following conditions voids the Limited Warranty:
- Failure to read or comply with any instructions and published guidelines provided by ALCHEMA in any form, either written or electronic, relating to any Product
- Failure to use any Product in a fashion compliant with any instructions and published guidelines provided by ALCHEMA in any form, either written or electronic
- Use of any Product in any way that is inconsistent with ordinary household use, including, but not limited to, commercial use or use for research and development purposes
- Use of any third party accessories, component, product or equipment with any Product that does not meet or adhere to ALCHEMA specifications or is not specifically recommended or approved by ALCHEMA
- Damage caused by any maintenance or repair service that is not performed by ALCHEMA or authorized in advance by ALCHEMA, including, but not limited to, upgrades
- Damage to any Product arising from any non-ALCHEMA-branded product
- Alterations to any labels, stickers or serial numbers affixed to any Product, including, but not limited to, removal, changes, or defacement
- Alternations to any warranty card, invoice or receipt for any Product, including, but not limited to, removal, changes, or defacement
- Alterations to any internal or external mechanism or part contained in any Product, including, but not limited to, disassembly or modification
- Exposure of any Product to abnormal or extreme conditions, including, but not limited to, placing, submerging, or operating any such Product in liquid/water, which may result in internal corrosion
- Theft or loss of any Product in which you are unable to prove authorized purchase or use, by, for example, proof of purchase information.
- User negligence, abuse, or misuse in installing, operating, or using any Product
- Any personal injury caused by any Product
THE REMEDIES DESCRIBED IN THE ABOVE LIMITED WARRANTY ARE THE SOLE AND EXCLUSIVE REMEDIES AVAILABLE TO YOU WITH RESPECT TO ANY PRODUCT SOLD BY ALCHEMA. No retailer, reseller, agent, employee or representative of ALCHEMA is authorized to make any modification or addition with respect to the above warranty. No retailer, reseller, agent, employee or representative of ALCHEMA is authorized to make any additional warranty to you. ANY STATEMENT MADE BY ANY RETAILER, RESELLER, AGENT, EMPLOYEE OR REPRESENTATIVE OF ALCHEMA PURPORTING TO ADD, MODIFY, OR CONTRADICT THE ABOVE LIMITED WARRANTY IS VOID AND LEGALLY UNENFORCEABLE.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALCHEMA HEREBY DISCLAIMS ANY AND ALL LIABILITY FOR SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY LEGAL THEORY AND/OR CAUSE OF ACTION RELATING TO ANY PRODUCT SOLD BY ALCHEMA, INCLUDING, BUT NOT LIMITED TO, CAUSES OF ACTION IN CONTRACT, INDEMNITY, WARRANTY, TORT (INCLUDING NEGLIGENCE), AND STRICT LIABILITY.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALCHEMA HEREBY DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTY OF MERCHANTABILITY, IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND WARRANTY AGAINST HIDDEN OR LATENT DEFECTS.
IF ALCHEMA CANNOT DISCLAIM A GIVEN STATUTORY OR IMPLIED WARRANTY UNDER APPLICABLE LAW, THEN ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THE ABOVE LIMITED WARRANTY.
THIS LIMITED WARRANTY GIVES YOU CERTAIN RIGHTS AND YOU MAY HAVE ADDITONAL LEGAL RIGHTS BASED ON YOUR PLACE OF RESIDENCE. Except as permitted by law, ALCHEMA does not exclude, limit or suspend these other rights you may have that arise from the laws of your place of residence; so the disclaimers listed above may not apply in your place of residence. Residents of Quebec are governed by that province’s consumer protection legislation.
IF YOUR ALCHEMA-BRANDED PRODUCT IS CAPABLE OF STORING SOFTWARE PROGRAMS, DATA AND OTHER INFORMATION, YOU SHOULD MAKE PERIODIC BACKUP COPIES OF THE INFORMATION CONTAINED ON THE STORAGE MEDIA TO PROTECT THE CONTENTS AND AS A PRECAUTION AGAINST POSSIBLE OPERATIONAL FAILURES. Similarly, before submitting your Product for warranty claim you should maintain a separate backup copy of the contents of its storage media, remove all personal information that you want to protect and disable all security passwords. During warranty service it is possible that the contents of the Product’s storage media will be lost, replace or reformatted. In such an event ALCHEMA and its agents are not responsible for any loss of software programs, data or other information contained on the storage media or any other part of the Product serviced. Following warranty service your Product or a replacement device will be returned to you as your Product was configured when originally purchased, subject to applicable updates. You will be responsible for reinstalling all other software programs, data and information. Recovery and reinstallation of other software programs, data and information are not covered under this Limited Warranty.

This Limited Warranty is governed by and construed under the laws of the country in which the Product purchase took place. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
Notice Concerning the Quebec Legal Warranty (applicable only to Residents of Quebec):
The Consumer Protection Act provides a warranty on the goods you purchase or lease: they must be usable for normal use for a reasonable length of time.

The Consumer Protection Act gives a warranty on all goods you purchase or lease from a merchant.
The goods must be usable:
- for the purposes for which they are ordinarily used (Section 37 of the Act); and
- in normal use for a reasonable length of time, which may vary according to the price paid, the terms of the contract and the conditions of use (Section 38 of the Act).
